Denial of GP5400 by Sr.DPO/TVC
Based on RBE No.142/2012 dated 13/12/2012 Sr.DPO/TVC(SR) has denied third MACP of technical supervisors ie GP 5400 after 30 years of service in GP 4200 stating that Asst.Offrs GP is only 4800.Is it not misinterpretation of Railway Board order and violation of MACP concept of Govt of India. Please comment.

Sub:-Grant of financial upgradation under MACP Scheme-Clarification reg.
References have been received from Zonal Railways seeking clarification as to what Grade Pay would be admissible under MACP Scheme to an employee holding feeder post in a cadre where promotional post is in the same Grade Pay. The matter has been examined in consultation with Department of Personnel & Training (DoP&T), the nodal department of the Government on MACP Scheme and it is clarified that ACP/MACP Schemes have been introduced by the Government in order to mitigate the problems of genuine stagnation faced by employees due to lack of promotional avenues.
Thus, financial upgradations under ACP/MACP Schemes CANNOT be to higher Grade Pay than what are be allowed to an employee on his normal promotion. In such cases financial upgradation under MACP Scheme would be granted to the same Grade Pay.
This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sir,
If in this case the entry GP is 4200/- in JE,he will get 5400/- GP after completion of 30 years service.
The above mentioned circular is for the case where feeder post and promotional post carrying same GP .For example for MCM,the promotional post is JE.Both posts carrying same GP of 4200/- and merging of these post is not possible due to functional problem.so in such case MCM will get only one increment in promotion to JE or in the case of MACP and no change in GP.if MCM have been given 4600/- GP in 1st MACP it will be more than actual promotional benefit which is against the spirit of MACP. But in 2nd macp ,if due,he will get 4600/- GP.(normally in the case of MCM the question of MACP will not arise as they already availed 3 promotion.I'am just showing an example.)

Dear Sir,
Thank you for the explanation.Your example is correct.But the problem is to convince certain section of people who always think negatively .The above RB order is clear by saying the applicability is only when GP of feeder post and promotional posts are same.But unfortunate to some of the SSEs/JEs of TVC Divn. this misinterpretation happened and now they have to fight for.Is there any similar action by some other units?Any clarification by RB?

Sir,
So many SSEs got 5400/- GP after 30 years service in mumbai division and other railways.Here no body interpreted this order in such a away your Sr.DPO said to have done.RB reiterated their order on 05/03 in a reply to NFIR .

All who have completed 30 years of service excluding the initial training period, and who have not got the three promotions / financial upgradations are eligible for third financial up-gradation. In the case of DR quota JEs it should be Rs.5400 GP. All Railways are implementing it including S.Rly.

Thank you Er.Ramesh for your reply.Now the unwanted doubts are once again cleared by RB vide lr.no.No PC-V/2 009 I ACP 120/CLW dt.05-03-13.But there will be Sr.DPO's with anti staff attitude again make misinterpretations to prevent the staff from getting their meagre benefits after long service.

please clarify how the SMs are getting 5400/-GP.what is their entry grade.
